These Terms & Conditions (“Terms”) govern your use of the websites operated by Informed Motion Group, INC, including informedmotion.com and any related domains, and any consultation or contact request submitted through them (collectively, the “Site”). Informed Motion Group, INC (“IMG”) provides website diagnostics, version assessments, platform health checks, upgrade and modernization reviews, consulting, GEO and SEO services, AI visibility services, and related application and web development services to businesses in the United States. Any information, preliminary findings, or recommendations provided through the Site, including through automated tools, reports, or emails, are for general informational purposes only and do not constitute final consulting advice unless covered by a separate signed services agreement.

Submitting a form on the Site does not guarantee any specific finding, timeline, deliverable, or outcome. All assessments depend on the accuracy and completeness of the information and access provided for review.

2. SMS / Text Messaging Terms

By providing a phone number through the Site and submitting a form, the user consents to receive SMS/text messages from IMG regarding requests, consultation scheduling, account updates, project updates, and other transactional communications related to IMG services.

IMG does not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any results or recommendations will be complete, accurate, or suitable for any specific need.

9. Limitation of Liability

To the fullest extent permitted by applicable US law, IMG and its directors, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, business opportunities, or goodwill arising from the use of, or inability to use, the Site, reports, diagnostics, or SMS communications

Where liability cannot be excluded under mandatory law, IMG’s total aggregate liability arising out of or relating to the Site or these Terms should be limited to the amount paid, if any, for services directly related to the claim during the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded.

10. Privacy

IMG collects and processes personal information, including names, contact details, company information, technical environment details, and phone numbers, when users interact with the Site, request diagnostics, or participate in the SMS program.

The state and federal courts located in or serving Montgomery County, Pennsylvania, should have exclusive jurisdiction over disputes arising from these Terms or the use of the Site, subject to any mandatory jurisdictional rules.
